TermsThe agreement
Plain language, no traps.
Last updated 8 September 2026. These terms explain the agreement between you and MODAME when you use the service.
01
About these terms
These Terms of Service are an agreement between you and MODAME APP PTY LTD (MODAME, we, us or our). They govern your use of the MODAME website, applications and related services. By creating an account or using the service, you agree to these terms and our Privacy Policy. If you do not agree, do not use MODAME.
02
Eligibility
You must be legally able to enter this agreement and must not use the service if applicable law prohibits you from doing so. If you are under 18, you may use MODAME only with the involvement and consent of a parent or legal guardian where required by law, and that person must review and agree to these terms on your behalf.
03
Your account
You must provide accurate account information and keep it current. You are responsible for protecting your sign-in method and for activity under your account. One account is intended for one person's wardrobe and style profile. Tell us promptly if you suspect unauthorised access. We may require reasonable steps to verify account ownership before acting on sensitive requests.
04
Permitted use
MODAME gives you a personal, limited, non-exclusive, non-transferable and revocable right to use the service for lawful, non-commercial personal styling and wardrobe-management purposes, subject to these terms. Any rights not expressly granted remain with MODAME and its licensors.
05
Your content
You retain ownership of photographs, garment details, notes, preferences and other content you upload. You grant MODAME a worldwide, non-exclusive, royalty-free licence to host, copy, process, adapt and display that content only as reasonably needed to operate, secure and provide the service to you. This licence ends when the content is deleted, except for temporary backup copies and information we must retain by law. You confirm that you have the rights and permissions needed to upload your content.
06
MODAME intellectual property
The MODAME service, brand, software, interface, designs, reasoning language, editorial material and other content we provide are owned by or licensed to MODAME and are protected by intellectual-property laws. You may share ordinary screenshots or brief quotations for personal commentary with appropriate credit, but may not copy, sell, sublicense, remove notices from, or create a competing service from our materials except where law expressly permits it.
07
AI and styling recommendations
MODAME uses automated and AI-supported systems to analyse wardrobe information and generate styling suggestions, classifications and explanations. These outputs are informational, may be incomplete or incorrect, and are not guarantees of fit, appearance, availability, suitability or any particular outcome. Use your own judgement, especially where health, safety, workplace rules, cultural expectations, weather or an event dress code matters. MODAME does not provide medical, legal, financial or other regulated professional advice.
08
Third-party services
MODAME may rely on or link to third-party services, including authentication providers, app stores, payment processors, maps, calendars, weather services and AI or infrastructure providers. Their own terms and privacy policies may apply to your use of them. We do not control third-party services and are not responsible for their content, availability or independent handling of information, except to the extent applicable law provides otherwise.
09
Prohibited misuse
You must not use MODAME unlawfully; infringe another person's rights; upload harmful, deceptive, abusive or unauthorised content; impersonate someone; interfere with security or operation; introduce malicious code; scrape or access the service by unauthorised automated means; probe or circumvent access controls; reverse-engineer the service except where law permits; or use outputs, content or access to build or train a competing product without our written permission.
10
Subscriptions and payments
MODAME does not currently offer self-service paid subscriptions. If we introduce paid features, the price, billing period, renewal and cancellation terms, included features, and payment method will be shown before purchase. App-store or payment-provider terms may also apply. Any refunds will be provided in accordance with applicable law, including the Australian Consumer Law, and any additional terms shown at purchase.
11
Availability and changes
We work to keep MODAME available, but do not promise uninterrupted or error-free access. We may maintain, change, add, suspend or discontinue features where reasonably necessary. We will give reasonable notice of material changes that significantly reduce a paid service where practicable. We are not responsible for events outside our reasonable control.
12
Suspension and termination
You may stop using MODAME and request account deletion at any time. We may restrict, suspend or terminate access if you materially or repeatedly breach these terms, create risk or harm, fail to pay applicable charges, or if we are required to do so by law. Where appropriate, we will give notice and a reasonable opportunity to remedy the issue. Provisions that by their nature should continue after termination—including ownership, disclaimers and liability limits—will survive.
13
Disclaimers
To the extent permitted by law, MODAME is provided on an as-is and as-available basis, and we disclaim warranties not expressly stated in these terms. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.
14
Limitation of liability
To the extent permitted by law, MODAME is not liable for indirect, incidental, special or consequential loss, loss of opportunity, or loss of data arising from use of the service. Where applicable law permits us to limit a remedy for failure to comply with a statutory guarantee, our liability is limited, at our option, to resupplying the affected services or paying the reasonable cost of having them resupplied. These limits do not apply to liability that cannot be excluded or limited by law, including liability arising from fraud, wilful misconduct or applicable consumer guarantees.
15
Governing law and disputes
These terms are governed by the laws of Victoria, Australia, and the laws of Australia that apply there. You and MODAME submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them. Nothing in this section limits rights you may have under mandatory laws of another place. Please contact us first so we can try to resolve any concern directly.
16
Changes and contact
We may update these terms as the service or law changes. We will publish the updated terms here, revise the date above, and provide reasonable advance notice of material changes where appropriate. Continued use after updated terms take effect means you accept them. Questions about these terms can be sent to hello@modame.app or through the contact page.
